Homeowner's associations may have oversight in South Carolina

If you're part of a homeowner's association, then you know there could be fees, regulations and other costs associated with joining that association and living in your particular neighborhood. Some people have been complaining about the cost of obtaining financial reports from their homeowner's associations, if they can at all. Additionally, the documents they are able to receive may come at a cost.

Now, there are a few pieces of legislation that are trying to be put into action to help with these issues. One agenda wants to address what Realtors would consider excessive fees for association documents. The issue with the cost of these documents is that it can make it hard to obtain them. Those documents, though, are often important for those who want to buy the homes. Additionally, the documents are something homeowners have a right to see; buyers need to know what they're getting into when they make a purchase.

It's been said that homeowner's associations have not listened to people in the past. One complaint that was reported was characterized as someone saying the homeowner's associations don't listen and only do as they please. That and the fact that the homeowner's associations can be expensive to fight has brought legislators to the conclusion that some oversight may be needed.

Legislators in South Carolina would also like to see some training and the potential certification of property management companies. They have also said that a mediation process would be beneficial because at present, homeowners have to seek legal help and then take the homeowner's association to court, which is costly and can be overwhelming.
